SwimKeeper Terms of Service

These Terms of Service (“Terms”) are an agreement between you and KCB Systems LLC (d/b/a SwimKeeper), a Pennsylvania limited liability company (“SwimKeeper,” “we,” “us”) governing your use of the SwimKeeper application and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be 18 years or older and a parent or legal guardian to create an account. By creating an account you confirm that you are 18+, and that you have the authority to provide and manage information about the swimmers you add to your household, including any children under your care. Children may not create or use their own accounts.

The Service is currently offered only to households in the United States. We may open it to other countries in the future; until we do, please do not create an account from outside the United States.

2. The Service

SwimKeeper is a private, family‑controlled journal for manually recording and reviewing swim performances — meets, results, splits, notes, goals, and progress toward time standards. It is not a public rankings, recruiting, team‑management, or meet‑management platform, and (in this version) provides no public profiles, social features, or messaging.

3. Your account and your responsibilities

  • You are responsible for your account credentials and for activity under your account. Keep your password secure and notify us of any unauthorized use.
  • You are responsible for the accuracy of the information you enter and for having the right to provide any information about other people (including minors in your household).
  • You agree to use the Service only for its intended, lawful purpose.

4. Acceptable use

You agree not to:

  • Use the Service to store or share unlawful content, or to infringe anyone’s rights;
  • Attempt to access data belonging to other households or to bypass the Service’s access controls or security;
  • Scrape, bulk‑extract, or harvest data from the Service except via the export tools we provide for your own household’s data;
  • Probe, overload, disrupt, or reverse‑engineer the Service, or use it to build a competing dataset from other users’ information;
  • Misrepresent your identity or eligibility.

5. Your content and data

You retain ownership of the information you enter (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you (for example, to store your swim history and compute personal bests, season bests, and progress toward your goals and time standards). We do not claim ownership of Your Content, and we do not sell it. You can export and delete Your Content at any time as described in the Privacy Policy.

6. Privacy

Our handling of personal information, including children’s information, is described in the Privacy Policy, which is incorporated into these Terms.

7. Changes to the Service

The Service is offered on an evolving basis. We may add, change, or remove features, and during beta the Service may be unstable or interrupted. We may also modify these Terms; if we make material changes we will update the “Last updated” date and provide reasonable notice. Continued use after changes take effect means you accept the updated Terms.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error‑free, or that data will never be lost; keep your own copies via the export tools.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIMKEEPER AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

10. Dispute resolution; binding arbitration; class action waiver

Please read this section carefully — it affects your legal rights.

Except for disputes that qualify for small claims court, or claims for injunctive relief to protect intellectual property or prevent unauthorized access to the Service, you and SwimKeeper agree to resolve any dispute arising out of or relating to these Terms or the Service through binding, individual arbitration rather than in court, as described below.

  • Informal resolution first. Before starting an arbitration, contact us at [email protected] and give us 30 days to try to resolve the dispute informally.
  • Arbitration. Any arbitration will be administered by the American Arbitration Association (AAA) under its consumer arbitration rules, and may be conducted by phone, online, or in writing unless an in‑person hearing is required by those rules.
  • No class actions. You and SwimKeeper each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
  • Opt out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first creating an account, with the subject line “Arbitration opt‑out.” Opting out does not affect any other part of these Terms.

11. Termination

You may stop using the Service and delete your account at any time from the You screen, which permanently removes your household’s data. We may suspend or terminate access if you violate these Terms or to protect the Service or its users.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict‑of‑laws rules.
